Preamble
To conclude this almost 100 points’ strong marathon of FAQs, we
look at some generalities……

15) The ideal
speed breaker
A 'speed-breaker', as the name implies, is meant to force one to slow down
- failing which he stands to go for a toss - whatever that means.
However, to minimise the hazard of such a 'toss', Countries have their
own National Standards which lay down the 'dimensional -profile of such
a speed breaker. The Bureau of Indian Standards has one - the details
of which you can get by surfing the BIS Website via Google.
16) Phasing out of old cars
Like the imposition of EU-II norms wef April 2000, the EU-III will also
apply to new cars only and that too in the Metro/sub-Metro's.
To the best of my knowledge, the Govt is depending on natural attrition
of old Cars and they're progressively getting out numbered anyway. As
of today, there are no rules in place and probably there never will be,
as it'd call for an amendment to the earlier Parliament-enacted Motor
Vehicles Act/1989. As such, no regional RTOs or High Courts can pass such
dictats.
Besides, it cannot be done for the simple reason that people even in the
developed countries have a right to preserve their cars upto/beyond them
becoming vintage !
And the beauty of laws out there is such that the same pollution norms
apply to older vehicles when seeking the mandatory road fitness certifications
as were in force when it first came on roads ! They've even gone and made
leaded petrol officially available to them coz they cldn't stomach ULP's!!
However, there could be a possibility to induce people to convert their
older cars into gas running from pollution control point of view - atleast
in the sub/Metro's. For more insights reg conversion to Gas, you're invited

17) Getting out of a Car Loan/Hypothecation
To get your Car out of the hypothecation, you have to make a request in
writing towards 'fore-closing' the loan to the Finance Co. - by a date
preferably in the middle of a month and giving them atleast a months notice
at the same time.
Upon receipt of such a notification, the FC will respond by letting you
know in writing the following costs :
i) The Principal amount that would be outstanding on the desired date.
ii) A penalty towards fore-closing - which is usually @ 5% of the above,
and
iii) Interest that would be due on (ii) above by the chosen date.
You have then to send them a suitable Bank DD for the above amount and
if they are an efficient lot, they should come back to you within a fortnight
of receipt of your DD with the following Docs :
a) A letter on it's letterhead Addressed to the RTO - stating that the
loan stands liquidated and the Hypo may be removed from the RC.
b) A similar letter Addressed to the Insurance Co.
c) RTO Form # 35 in duplicate, duly discharged from their side. This Form
normally has a validity of 90 days from the date of its execution.
Upon receipt of the 3- docs as above, you'll have to apply to your RTO
with a) and b) above, along with your RC in original and a copy of the
valid Insurance/PUC Certificate, requesting for the needful.
They'll levy some nominal administrative charge for doing the needful.
For the interim period, retain a Gazetted Officer Certified True Copy
of the RC amongst your other Car Papers. This bit one can entrust to the
Automobile Association if one is a Member and just becoming one for the
purpose is worth it.
Once the new/revised RC is recieved, you will then have to apply to the
Insurance Co with a Copy of the amended one along with (b) above to get
the needful done.
BTW, if your Loan is from Citibank - be prepared for delays and lack of
transparency in this exercise - as I experienced personally/recently.
