JAGDISH N M's query :sir, to my last querry for registration for sidecar activa scooter , you had advised me to meet RTO. Accordingly I met Dy. RTO, but he cited inability due to some instructions from TC. Sir, don't you feel that this is harrasment to large disabled users / drivers of Invalid Carriages. The TC/RTO should know that no auto transmission scooter manufactures / supplies with sidecar fitted scooter, hence treating this as other form of or on par with alteration is wrong. Further what facts & figures Dept. has for such usage of Invalid Carriges & thier accidents, traffic violations, etc. Also further MV Act provides for sidecar / invalid carrige registration & its tax exeption & also motor insurance tarrif provides for discount for fitting sidecar & also for usage by disabled.Sir, pl. advice for resolving the issue.
Dr. Pasricha Answers : I advise you to get in touch with the Transport Com (Mr.Shinde) on Mumbai telephone No. 26516336. I am sure he will try to resolve your problem.

 
RAJNEESH's query :Dear Dr. Pasricha, I am currently located in Noida and moving to delhi. I currently own a Optra which is currently registered in the company's name. I would be transferring the ownership to my name before moving to B'lore. My questions are 1. Can I get a refund of the difference in the corporate and individual registration rate from the UP RTO? 2. As I have to pay for the road tax in B'lore can I get a refund from UP for the tax already paid? 3. Do I have to pay for entry tax and octroi in Karnataka? 4. What are the rates for all the above taxes in Karnataka? I would like to know the procedures in going thru with this. Thanks
Dr. Pasricha Answers : Yes, there is a refund formula and you will be entitled to refund in accordance with it. It varies from State to State. You will also be entitled to refund of road tax in U.P. after you have paid one in Bangalore. If the vehicle is older than 15 months, you do not have to pay entry tax. However, octroi will be applicable on the market price.

 
JOJI MATHAI's query :Sir, I have a Santro vehicle registered in Mumbai in Oct 2005(Life Time tax paid). I have shifted it to Bangalore for few months. Having read your replies in this section and since I wouldnt be staying for more than a year here, I applied for a temperory registration. The officer stated that there was no such rule and that I should show him the rule and give him the ACT no. Sir, Can you please give me the details they have asked for. They also said since it is Oct 2005 vehicle, I will have to pay an entry tax before I bring the vehicle into Karnataka. Is this true? Thanks, Joji
Dr. Pasricha Answers : There is no provision for temporary registration if you are going to stay in another State for a period less than a year. It will be sufficient to inform the R.T.O. in new State and pay nominal road tax as is applicable for the period you are planning to stay in that State. However, if you intend to stay beyond one year, you will have to re-register your vehicle and there are no exceptions.

 
PUNEET BAGGA's query :Sir,I've driving license from RTO janak puri & passport address changed to Rohini. Will I face problem in getting International driving license from rohini?
Dr. Pasricha Answers : Yes, you will not get the International Driving Permit unless the address appearing in your driving licence and passport tally.

 
ARPAN_BANSAL's query :Dear Sir, I have a Maruti 800, 2001 model. I bought it from Marutee true value in Delhi. Now I am shifting to Pune. What kind of taxes will have to be paid there if I shift my car? Approximatly how much will be the charges? What do you advise, should I sell it in Delhi or take it along? Thanx and Regards Arpan
Dr. Pasricha Answers : You will have to pay lifetime road tax as applicable in Pune, besides octroi on the market price of the vehicle. Of 'course, you can then approach the R.T.O. in Delhi for refund of road tax already paid there. Since it is a fairly old vehicle, I advise you to sell it in Delhi and purchase another one in Bangalore. It will be cost-effective.

 
RAMAPRAKASH's query :I am having a 2002 Delhi registration car and am getting transferred to Bangalore for duration 6 months to 2 years (not sure). In this case, what legal issues have to be taken care of with regards to moving my car from Delhi to Bangalore?
Dr. Pasricha Answers : If you are going to stay beyond one year in Bangalore, it is mandatory to get the vehicle re-registered. Since you are not sure, you may initially inform the R.T.D. in Bangalore about your intention of staying for a period of few months, but less than a year. You will have to pay some nominal road tax as is applicable, and if later you change your mind and you decide to stay beyond one year, you should inform the R.T.O. in Bangalore again and obtain N.O.C. from the R.T.O. in Delhi for legal formalities of re-registration.

 
YANKIE's query :sir, i bought a bike from delhi on 17/06/06. it was told to me that i will be getting rc in the next three months. now i am driving my bike in kolkata and i will be staying here for just about an year.i have not got my noc with me here.what are the documents i need to get it done to drive in kolkata and stop paying bribes to the cops.
Dr. Pasricha Answers : Since you are not going to stay beyond one year, you do not have to get the vehicle re-registered in Kolkata. You should have got the R.C. immediately within a week of the registration of your vehicle in Delhi. You must take up with the R.T.O. or the Transport Commissioner. You should inform R.T.O. in Kolkata about your intention of staying in the city for a few months. You will have to pay some nominal road tax as is applicable.

 
DHEERAJ's query :I bought Alto LX in Bangalore Dec'2005. I came to Hyderabad in March'2006. I took NOC from Bangalore in April'06. I have 3 questions 1)Do i need to pay Road Tax and Entry Tax (for AP registration)2) Can i pay Road Tax in AP (do not pay any entry tax and drive the vehicle with KA registraion in AP)? 3) what is validity of NOC i had taken from RTO, Bangalore? Do i need to submit the NOC to RTO or it will be cancelled automatically if i dont use it? Thanks
Dr. Pasricha Answers : Since your vehicle is less than 15 months in age and you are planning to drive it in a State other than it was initially registered, you will have to pay entry tax and road tax, as is applicable. You can drive a vehicle in another State only up to one year and for staying beyond that period, you will have to re-register it in Bangalore. The validity of N.O.C. is generally 30 days. If you do not use it, it will be deemed to have been cancelled, but you are expected to inform your R.T.O. in Bangalore.

 
SAUMITRA CHAKRABORTY's query :Dear Sir, I relocated to Noida from Nashik in 2004 and got an NOC from RTO Nashik in 2004 to transfer my Bajaj Spirit two wheeler.Due to some reasons I could not get the two wheeler registered in UP.I am not using the two wheeler since. Now I am being transferred to Kolkata and would like my two wheeler to get registered at Kolkata itself to use it there.Could you please inform what procedure should I follow.I would prefer to avoid visiting Nashik for this purpose if possible.Regards
Dr. Pasricha Answers : You should obtain a fresh N.O.C. from the R.T.O. in Nashik and then produce your vehicle in Kolkata along with all documents in original. The N.O.C. can be obtained through one of your contacts or even by post.

 
MANDAR KAPREKAR's query :Sir, I am returning to India after 2 years of stay in Dubai. I wish to get my 2 years old Pajero along with me to India. Kindly advice about applicable import duties.
Dr. Pasricha Answers : Import duty keeps varying. You are advised to get in touch with the Customs Department to obtain this information.
