GAUTAM KUMAR's query :I bought my car in september 2003 in Navi Mumbai. Now, I have moved to Bangalore. Do I need to pay the entry tax. If yes then what is the procedure.
Dr. Pasricha Answers : If you are going to use your vehicle in Banglore for a period exceeding one year, re-registration is legally mandatory. You will have to obtain NOC from your RTO in Mumbai and then present your vehicle before RTO in Banglore alongwith registration tax payment and insurance certificate. You will have to pay Life Time Tax in Banglore as per their rules and then request for refund from Mumbai for the unused period. There is no uniformity in road tax structure in the country, every state has its own rules. Since your vehicle is older than 15 months you need not pay entry tax.

 
MANISH ISRANI's query :I have bought a 1995 Maruti Esteem recently . The RC Book shows the 1st owner as some company in Daman & Diu where this vehicle was registered in 1995. The vehicle was then brought to Dahanu in 1997 and registered under Thane RTO by its 2nd owner. It was then bought buy another person in Thane in 1999. Finally a spare part dealer bought this vehicle from the last owner, used it for a month and selled it to me. The RC book issued from Thane contains the details of Daman owner, Dahanu Owner and the last (Thane) owner . The RC book has stamps of Thane RTO on the last 2 owner’s detail with dates and signatures of RTO Thane officers. But for the 1st owner details it just says “---sd--- RTO Daman” with some old Daman Registration No. written on top of the 1st Page without carrying any stamp or signature. Also the RC book shows OTT paid in Mumbai in 1997. The spare part dealer from whom I have bought this car, has got the Form 28, Form 29 and Form 30 signed from the Last owner. Other papers like the Insurance, PUC seem to be OK. Could you tell me if the papers seem to be clear and I won’t land up in any sort of problems in getting the papers in my name, since the RC book carries no stamp of RTO Daman. Rgds, Manish
Dr. Pasricha Answers : Many people use to register their new vehicle in Daman & Diu area in order to avoid tax payments. Since the proposed vehicle have changed many hands in the last 9 years, I would not like to recommend this vehicle. However, you may get in touch with the RTO department and verify the records for the correctness.

 
NAITIK GUPTA's query :i am a resident of delhi&looking for a car registered in delhi,hence i would be thankful to you if you can tell me all the legal papers that are required to check before making a used car purchase .beside this,some sellers offer a car registered with other states, want to know how this inter state registration works&what extra charges i have to pay if purchasing a car from other state. also,i would like to know that can someone make his car register wrongly,i.e:willingly,say1996 purchased car registered as 2000 car.will be thankful for your suggestion.mail me at:naitikgupta@indiatimes.com or naitik_0809@rediffmail.com thanks
Dr. Pasricha Answers : You must go to only an authlorized and reputed dealer for the purchase of old cars, even if you have to pay their commission charges. It is very necessary to verify all the details in the registration book and check physically the engine and chassis number have been correctly endorsed. You should also find out whether insurance has been paid and verify from RTO if any dues or penalty pending against the owner.

 
AMIT SONI's query :Hi, I wanted to ask abt moving a vehicle from one state to other state. I hv moved from Delhi to Hyd. And my bike is registered in Delhi. So wht does rule say abt the same? TIA, -Amit
Dr. Pasricha Answers : Since you are moving from one state to another, it is mandatory to reregister the vehicle. You should NOC from your present RTO. Within the stipulated time you should physically produce your vehicle before your new RTO at Hyderabad alongwith registration, insurance, payment of tax and PUC certificate all in original.

 
PRADEEP AGARWAL's query :Sir, I have the Mruti800 1989 MODEL AND REGISTRATION IS AT KANPUR(15 YEARS PASSED) NOW I WANT TO BRING IT AT MUMBAI(PEN) PL.TELL US WHAT WILL BE THE RTO FORMALITIES(APP. MONEY TO PAY RTO)

THOMAS IRWIN D'SOUZA's query :Mr. Pasricha, While I agree that, the traffic authorities are perfectly authorized to tow away the vehicles when they are parked in No Parking areas, My questions therefore are follows, Are there any laws or rules applicable to these towing vehicles and personnel/police who man them? Do they have the right to damage the cars while towing them, Isn't it necessary that they take care not to damage the cars. Is there a provision in law to recover cost if the vehicles are damaged? What are the basic rules governing these marauders. Why are some of these 40-50 old towing vehicles allowed on the road, Are these vehicles roadworthy in the real sense in all aspects? Why is that there are 5 to 6 people are allowed to ride on the back of these towing vehicles, when there is a law that not more than one person can ride at the back of the normal goods vehicles. I have seen these guys riding these towing vehicles is such a dangerous manner dangling their legs so close to the rear wheels, I just cannot figure out why the law keepers cannot keep the law themselves first before trying to go and apply the law to others. In some instances, I have seen some of these guys keep one leg on the tray of the towing vehicle and another on the hood of the vehicle which is being towed, Is it safe? Why can’t the traffic guys buy or hire modern towing vehicles that do not damage the vehicles, which are being used in many other countries, which are safe to both the personnel and the vehicles being towed. (It’s a different matter that a lot of people say and it’s a common knowledge that these towing vehicles are owned (benami) by some police officers to earn extra income. This is an incentive itself to these police officers to tow as many vehicles as possible. Why can’t a simple adaptation be used like wheel clamps where the cars are parked in No Parking area and do not create a traffic hazard or obstruction, and the towing option should be considered only when above holds true. Why are these traffic police so arrogant and insensitive, when I posed a few questions which I have put here the police constable had the guts to tell me "Jyada baat mat karo, andar kar doonga"!!!!!!. It’s this kind of attitude from most of the police officers/constables which makes people hold them in utter contempt. Finally, I would like to say that, whoever parks a car or scooter in No Parking Zone/Area is not a murderer or common criminal, and let’s not treat them so.
Dr. Pasricha Answers : It is expected that the traffic police to ensure that no damages to the vehicle being towed. As per law any act of a public servant, if bonafide does not attract the provision of damage. However, you must make a complaint to the trafic police chief in case if your vehicle is damaged. You can always approach the insurance company for the compensation. You can contact the traffice chief on this number 24927234.

 
ANURAG's query :Sir, I have my Santro car purchased and registered in Bangalore and come chennai for 2-3 months for a training before going to US. Can I drive this in Chennai without any paperwork and tax etc or do I need to do some formality or keep some doc etc
Dr. Pasricha Answers : Since you are going to be in Chennai for a period less than three months you do not have to do any paper work. I advise you to keep the latest petrol receipt of Bangalore as well as the receipt you will get in Chennai, while driving the car. It will help you to explain in case of some over enthusiastic officer question you abour your stay in Chennai..

 
SURENDRAN's query :Hello Dr. pasricha, I have moved from delhi to pune and got my zen registered in Maharastra. I have paid entry tax for the vehicle since the vehicle is less than 6 months old when i brought to pune. Now i am moving to Bangalore permanently. Now my zen is 1 year and 9 months old. Pls explain whether i have to pay entry tax again in Bangalore. What is the minimum period over which the entry tak is not required for karnataka state.? Pls explain
Dr. Pasricha Answers : Entry tax is applicable only if the vehicle is not older than 15 months.

 
M. FAROOQ SHAIKH's query :Hello Sir , I am a graet fan of yours and really appreciate your contribution to traffic safety and particuuly modernising the entier traffic set up of this metropolis. Now , I am highlighting the problem being faced by me and seek your advise & indulgenge in the matter . Sir, I live at Byculla ( E) near Jijimata udyan ( E.S. Patanwala Road ) near BMC Maintenace chowky , this area was made NO PARKING when the JJ Flyover was under contruction and I am told the same has been gazzeted , but now since the contruction of JJ Flyover is over since two years this NO parking area restriction should have be removed and NO parking boards should have removed ; but the same has not happend , so also the no parking restriction has not been degazeted. Now the problem is the parked vehcles are towed away and the owners are penalised . There is no suitable parking space available . You will appreciate & agree that the area under refrence i.e E.S. Patanwala Road near Jijimata Udyan ( Rani baug) has a very minimal flow of traffic at any point of time even during the construction of JJ flyover . Hence request your kind self to advise as to how the no parking restriction can be removed now by due process of law and the agoiny & pain & harassmnet of the residents of the area under reference can be removed . SANJAY SINGH's query :Dear Sir, I purchased a second hand vehicle from Agra(UP) in April, 2004 and sold it in Chennai (Tamil Nadu) in June, 2004. Now for reregistration in the name of Buyer RTO is demanding for Entry Tax Certificate. I would like to know how much entry tax I will have to pay. Do I really have to pay entry tax, since the vehicle procured was second hand and is 2000 model. Please help
Dr. Pasricha Answers : If the vehicle is 2000 model, you do not have to pay entry tax.
