query :Hi,
I had purchased a M-800 in 1998 in Gurgaon and got it registered there. Subsequently, I moved to Bangalore in 2000. I also had an NOC at that time. Because of my travelling nature and being out of station quite frequently, I did not pay road tax in Karnataka nor got it registered in Karnataka. In 2003, I paid the road tax and also had to pay fine because of delay from my side. The car still continues to have the HR Regn and Number Plate. Now I am trying to sell the car in Bangalore and hence trying to get it registered in Karnataka. However RTO Bangalore is saying that the NOC of 2000 has expired and they need fresh NOC from RTO Gurgaon. This is quite impossible for me now since neither am i from Gurgaon nor do I now know anybody there who can do this for me. Can you suggest any way - I am willing to pay whatever it takes.

Answers : The R.T.O in Bangalore is absolutely correct that you will have to obtain a fresh N.O.C. from R.T.O in Gurgaon since the N.O.C. is valid only for 90 days. You have committed a serious offence and you must now take corrective action, earlier the better.

I was working with Tata Steel in Jamshedpur during which time i bought a scooter - a Honda Activa and it was registered in Jamshedpur, Jharkhand.
Subsequently i was transferred to Kolkata when I purchased a Maruti Alto Car (Bharat -III) which is Registered in West Bengal. The scooter remains registered in Jharkhand,i have been plying it in Kolkata without any problem.
I now taken up a new job in Delhi.
Do i have to re-register these vehicles, so that i can drive in Delhi, without facing problems?
If so how?

Answers : You should re-register your vehicle in Delhi after obtaining N.O.C. from R.T.O. in Jamshedpur. It is mandatory under the law.

query :i heard from u tht one has to change the regn if one wants to remain in state for more than an year with a car registered in another state. i want to know how the authorities will know this vehicle is there continuously for more than one year? (if one says he is just on a holiday trip?)

Answers : All law-abiding citizens are supposed to follow the law and should not bother whether the enforcement authorities come to know about it or not. But, if the enforcement authorities do come to know, you are in for serious trouble.

query :Dear Dr., We are having a Private Service vehicle having a permit to run from Thane to Andheri. What is the basic requirements for this vehicle for the driver, what documents are required to kept and we have been penalised heavily by RTO Tardeo and the Magistrate for not having the endorsement in the permit from Andheri RTO which we were not aware. Whether the driver of private service vehicle needs to have a bagde for driving the bus and what is the procedure to obtain that. Please give me your advise sir, so that I can educate so many staff in our office.

Answers : Your driver is supposed to keep the registration certificate, tax and insurance certificates, PUG certificate and driving licence, all in original, in the vehicle. For any public service vehicle (you are wrongly quoting as private service vehicle in your e-mail query), a badge is a must. You have to approach the concerned R.T.O.

query :I would want to shift to Pune within a year from Bangalore where I am currently residing. Can I buy a car in Bangalore but ask my dealer(or dealer in Pune) to get it registered in Pune since that is where I would go within a year? Or should I buy the car in Pune and bring it down here? In later case, do I have to bring NOC from Pune and pay the road tax in Bangalore? If you have any other suggestion/solution to my problem for me, I would be glad
to hear it.

Answers : The best would be to register your vehicle in Pune and then inform the R.T.O. in Bangalore about your intention to stay in the city for a few months. You will have to pay some token road tax, which will not be very high.

query :Dear Dr.Pasricha, I have been recently transferred from Bangalore to Delhi and I know reading your answers to queries that I need to get NOC from Bangalore and apply for registration at my local RTO in Delhi with all relevant papers. I enquired with one of the RTO officers and he said that no car can be registered with Euro -II emission standards in Delhi any more. My car is Santro XP ( Aug -2004)and I will incur huge financial loss if I try to sell it off. Is the RTO officer's view correct ? Whom do I approach to know the appropriate rules as on today ?

Answers : The R.T.O.’s contention is correct. As per the Supreme Court judgement, this rule has been made mandatory for the four metropolitan cities of Mumbai, Delhi, Kolkata and Chennai.

A consultant i asked informed me that it would take approximately 'One Year' to complete the formalities.According to him the application for re registration has to go to Delhi to complete the formalities. Answers : You have to first obtain an N.O.C. from R.T.O., Chennai and then physically produce your vehicle before the R.T.O. Kerala. You have to show him documents to prove that you are a resident of Kerala (or you have an office there). You will also have to show registration certificate, tax payment and insurance certificates and PUG certificate in original. The formalities for re-registration normally do not take more than 15 days.

Good Day,
This happened on Saturday [03’rd Dec, ‘05] at between 5:30 p.m. & 6:00 p.m. I was driving from Thane towards VT on the Eastern Express Highway . I suddenly noticed a truck parked just beyond the junction(opp Godrej Main Gate at Vikhroli), adjacent/ next to the road divider. It was facing the wrong/ opposite direction and had no hazard lights. The truck's headlights were turned off. The truck was either in the process of, or had just finished off loading construction material for some ongoing/planned road repair. There was no warning sign or board to warn the oncoming traffic of this hazard. My attention was diverted by this truck (my attention now being focused on the rear view/ LHS mirror) in order to turn left to avoid the truck safely. This caused me to miss noticing the the junction and the signal. [As is the norm in our country ther are no signs to warn traffic of an approaching junction]. I was promptly stopped by a traffic police officer [along with 4-5 other vehicles, for the same reason] who refused to listen to my pleas, and was fined a sum of Rs 100/- . He had no answer to my questions regarding the truck. I don’t miss the money but I do feel cheated. I have 3 questions for you Sir; 1) Was the officer correct in imposing the fine, when he was the one who had not taken care to remove the traffic hazard right in front of him. & 2.) What recourse does the law abiding citizen have in situation like this to ensure that proper action is taken against errant officials & 3) I am interested to know if there is any incentive scheme in place for traffic cops for collecting maximum revenue by way of fines?

Answers : All drivers are expected to drive with due caution. It may not be possible for a traffic cop to remove traffic hazards immediately, as he may require some help to do so. This is called defence driving. I suggest you read my book “ The Driver’s Manual”.
There is no incentive scheme for traffic cops if they collect higher revenue.
If you have specific complaint we have a well-defined hierarchy. You may approach the Police Inspector in charge or DCP Traffic or even Head of Mumbai City Traffic Branch.

Answers : You should get your vehicle re-registered with R.T.O. West in Mumbai. You will have to pay lifetime road tax in Mumbai and you can later claim refund from R.T.O., Chennai. You cannot use T.N. registration in Mumbai beyond one year.
